Meeting called to order by Vice Chairman Joseph Graceffo at 8:00 P.M. with a salute to the flag.

                     Vice Chairman Joseph Graceffo read the following:

 

This is a Regular Meeting of the Wanaque Borough Planning Board and adequate notice has been given and it has been duly advertised by the placement of a notice in the Trends and the Herald News, mailed on January 19, 2001 and a notice thereof has been posted on the bulletin board in the Municipal Building in the Borough of Wanaque and a copy thereof has been on file with the Borough Clerk.

 

MINUTES: from the September 20, 2001 Meeting:

 

MOTION TO APPROVE MINUTES FROM SEPT. 20TH MEETING: made by Member Brindisi, seconded by Member DiMeglio, voting yes were Members DiMeglio, Graceffo,

Brindisi, Platt and Slater.  Councilman Pasquariello abstained.

 

COMMUNICATIONS/REPORTS:  No questions asked.

 

APPLICATION STATUS: Eng. Cristaldi said he only had one new application that came in, which involves a three lot subdivision on Humbert Place. Eng. Cristaldi said he doesn’t want to waste the applicant’s time if the Board is going to want some road improvements to be done on Humbert Place. The applicant wants a three lot subdivision and the road is approximately 10 ft. wide. If the applicant is going to need road improvements it will be a major subdivision and the applicant would have to go to the

Board of Adjustment . Eng. Cristaldi said, its an R-40 Zone which means you need 40,000 sq. ft. and the lots involved are about 15,000, 17,000 and 18,000 sq. ft. If the Board is going to want off-site improvements such as the road being improved and the applicant may need to extend the water main, it will then become a major subdivision. Therefore, Eng. Cristaldi said, before they waste the applicant’s time, Eng. Cristaldi is trying to get an idea from the Board. Atty. Veltri responded by saying, why wouldn’t the

 Board want the road improved, and since they’re undersized lots, which make it a density issue, and because it’s a major subdivision if there’s a road improvement involved, the application would fall under the Board of Adjustment and not the Planning Board.

Vice Chairman Graceffo said, the Board should really refer the application to the Board of Adjustment. Eng. Cristaldi said, he would call the Board of Adjustment Attorney and explain the situation to him.

 

PLANNING BOARD REVIEW AND APPROVAL FOR INTRODUCTION OF ORDINANCE #17-0-01-AMEND RD-1 ZONE: All members received copies of this.

Planner Jill Hartmann said this amendment is affecting the site along Union Avenue only.

Atty. Veltri asked Planner Hartmann why these revisions are being made. Planner Hartmann said they’re being made because there is a redevelopment of the site with a potential for a restaurant and a hotel.

 

MOTION TO APPROVE ORDINANCE #17-0-01 AS AMENDED: made by Councilman Pasquariello, seconded by Member Brindisi, voting yes were Members DiMeglio, Graceffo, Brindisi, Platt, Councilman Pasquariello and Slater.

 

 APPLICATION #6-00 “Wanaque Landscaping and Garden Supply”, 1434 Ringwood Ave., Block 478 Lot 3, Site Plan Approval for two proposed sheds with Side Yard Variance:

Attorney Arnold Cohen sent a letter dated October 4, 2001 stating the applicant is withdrawing the application. Also, requesting an account of the escrow and a refund of any balances due.

PLANNING BOARD REVIEW AND APPROVAL OF REVISIONS TO #2-0-00 AN ORDINANCE AMENDING THE BOROUGH OF WANAQUE ZONING ORDINANCE, CHAPTER 114, TO ESTABLISH A NEW AAH ACTIVE ADULT HOUSING DISTRICT:

Planner Jill Hartmann explained to the Board, the amendment they have before them (Ms. Hartmann handed them out earlier in the evening), are the requirements that are consistent with the conditions of certification from the Council on Affordable Housing for the Borough’s Mt. Laurel obligation. Basically it changes the number of affordable housing units and the number of maximum market rate units. This is part of the requirement of the certification and is required to be passed within 45 days of October 6/7th when the Borough receives certification. Ms. Hartmann told the Board there are a

couple of more ordinances which are; the Affordable Housing Overly District RD-3-AHO and is located in the bird sanctuary and is a 6 acre site and is generally owned by the municipality and the density is 10 units per acre, and the Affordable Housing Districts AH-1, AH-2 and AH-3 which is broken down by maximum number of units which are AH-1 24 units, Ah-2 28 units and Ah-3 96 units. These particular properties have been approved at the Planning Board Meetings and this is the Housing Element of the Fair Share Plan that the Planning Board had Public Hearings on. Vice Chairman Graceffo asked what happens in terms of the Borough’s other ordinances that may implicate some of these properties such as the “Steep Slope Ordinance”. Ms. Hartmann said they actually won’t apply, and the “Steep Slope Ordinance” is only in the Subdivision Ordinance and there will be no subdivisions with these properties and steep slope sites are generally excluded from COAH requirements.

MOTION TO APPROVE AFFORDABLE HOUSING OVERLAY DISTRICT RD-3-AHO: made by Member Brindisi, seconded by Councilman Pasquariello, voting yes were Members DiMeglio, Graceffo, Brindisi, Platt, Councilman Pasquariello and Slater.

MOTION TO APPROVE ARTICLE XI BOROUGH OF WANAQUE ZONING ORDINANCE  114-63-82. AFFORDABLE HOUSING PROVISIONS WHICH HAS BEEN APPROVED BY COAH: made by Member Slater, seconded by Member Brindisi, voting yes were Members DiMeglio, Graceffo, Brindisi, Platt, Pasquariello and Slater.

 

OPEN TO PUBLIC DISCUSSION:

Grace Maiello, 26 Rhinesmith Ave., stepped forward. Ms. Maiello wanted to know about the property on Union Avenue that’s going to be developed for the hotel and string of stores. Ms. Hartmann said there’s no application, but the re-zoning that was being discussed earlier is the property adjacent to the Burger King towards Bloomingdale, but doesn’t include the lake. Vice Chairman Graceffo told Ms. Maiello the ordinance is separate from the question she’s asking. There are two separate parcels and two separate areas. One is adjacent to the Burger King which was zoned based on the vote tonight.  No application has been filed yet for the property on the opposite side of the street going north on Union Ave.

Stan Kazanowski, 38 Willow Avenue, Pompton Lakes, N.J. stepped forward. Mr. Kazanowski  said he has interest in Site 36. He said COAH determined that an acre and a half is buildable out of a 2 ½ acre site. If the builder submits engineering plans, can that area be re-developed for more buildable housing? Ms. Hartmann answered by saying that COAH has a steep slope requirement that they can eliminate property when they review the site. COAH came out and looked at that site and said that only 1 ½ acres under their requirements is developable. Ms. Hartmann continued by saying, its not that the site is not developable, its just that they determined that, however, the site after looking at what was approved in the Fair Share Plan, results in 14 market units and 4 affordable units. This comes to 18 units and has been permitted on the site and  what’s been approved by COAH and been approved by the Planning Board.
