REGULAR MEETING
Meeting called to order by Chairman Gilbert Foulon at 8:00 P.M. with a salute to the flag.

Reading: Open Public Meeting Announcement:
This is a Regular Meeting of the Wanaque Borough Planning Board and adequate notice has been given and it has been duly advertised by the placement of a notice in the Trends and the Herald & News, mailed on January 17, 2003 and a notice thereof has been posted on the bulletin board in the Municipal Building in the Borough of Wanaque and a copy thereof has been on file with the Borough Clerk.

MOTION TO APPROVE: made by Member Slater, seconded by Member DiMeglio, voting yes were Members DiMeglio, Chairman Foulon and Slater Members Graceffo and Verba abstained.
COMMUNICATIONS: No questions asked.
APPLICATION STATUS: The Board Secretary told Chairman Foulon the applications on the Agenda for the May 15th Meeting are R.S.K. Development (Townhouses on Mountain Ave.) and an Amended Site Plan Application for Sassafrass Properties for a Free-Standing Pylon Sign.
NEW BUSINESS APPLICATION: “Natural Wisdom” (Office, Bookstore & Gift Shop), 1087 Ringwood Ave., Block 437 Lot 1.01. Owner of building is David & Mary Johnson and owner of business is Patricia Lehman. Ms. Lehman came forward and told the Board she is a Certified Hypnotherapist and is looking for a place to put her office and have a little retail business of natural things such as soap etc., religious books and gifts. Ms. Lehman said she needs the office for hypnotherapy such as weight loss, smoking and stress management. There will be only one or two employees altogether. Ms. Lehman said the landlord Dave Johnson is taking care of the work that has to be done in the store.
MOTION TO APPROVE SUBJECT TO REINSPECTIONS ARE DONE AND SATISFACTORY CONDITION: made by Member Graceffo, seconded by Member Slater, voting yes were Members DiMeglio, Chairman Foulon, Graceffo, Slater and Verba.
NEW BUSINESS APPLICATION: “Parties Are Us” (Food & Entertainment for Birthday Parties), 207 Ringwood Ave., Block 204 Lot 5. Owner of building and business is Mounir Zikra.
Mr. Zikra came forward. Chairman Foulon asked Mr. Zikra how many businesses are in the building right now. Mr. Zikra said, a supermarket, liquor store, dance studio, and there will be two gyms. Mr. Zikra said he is approved for eight (8) businesses altogether. Atty. Veltri asked Mr. Zikra if he was the owner of the building and Mr. Zikra said yes. Atty. Veltri also asked if he had the original resolution for approval on this site. Mr. Zikra said he does have one. Atty. Veltri wanted to know why Mr. Zikra believes he is entitled to eight units in the building. Mr. Zikra said that’s what the resolution says and it came from the Board of Adjustment. Chairman Foulon told Mr. Zikra he has to comply with the inspector’s requirements. Mr. Zikra said he understood that. The Board Secretary went into her office and got a copy of the resolution for Atty. Veltri’s review. Atty. Veltri asked Mr. Zikra if he was familiar with the resolution and Mr. Zikra said yes. Atty. Veltri asked Mr. Zikra to help him out and find where in the resolution does it say he’s entitled to eight (8) businesses. Atty. Veltri said, unfortunately the Board of Adjustment Resolution doesn’t specify the number of units allowed. Atty. Veltri said he would recommend the approval of a CO subject to confirmation from the Board of Adjustment that they did authorize this number of units for the site. If they did, Mr. Zikra won’t have to come back, if they say they didn’t, then what the Board says tonight will become null and void. Chairman Foulon decided to leave it up to the Building Inspector, Jeff Brusco. Atty. Veltri asked the Board Secretary to have Jeff Brusco call him on this matter.
MOTION TO APPROVE & NO CERTIFICATE OF OCCUPANCY IS TO BE ISSUED UNTIL IT IS DETERMINED THE NUMBER OF UNITS ALLOWABLE AND ALL INSPECTIONS ARE FAVORABLE: made by Member Graceffo, seconded by Member Verba, voting yes were Members DiMeglio, Chairman Foulon, Graceffo, Slater and Verba.
NEW BUSINESS APPLICTION: “New Vision Health Club” (Gym), 207 Ringwood Ave., Block 204 Lot 5. Owner of building is Mounir Zikra and owner of business is Luis Guevara. Atty. Veltri told Mr. Guevara the Board doesn’t want him to put a lot of money into the unit until the Board receives verification of how many businesses are allowed in this building. Mr. Guevara said he understands what Atty. Veltri just told him. The Board Secretary will have the Building Inspector get in touch with Atty. Veltri in regards to this matter. Chairman Foulon reminded the owner that he needs two fire extinguishers mounted, one upstairs and one on the ground floor.
