Regular Meeting
April 27, 2010


A Special Meeting of the Mayor and Council of the Borough of Wanaque was held on Tuesday, April 27, 2010 at 8:40 P.M. in the Wanaque Municipal Building.

The Mayor called the meeting to order with the flag salute.

ROLL CALL:

On roll call, the following Council Members responded: Balunis, Cisco, Cortellessa, Pasquariello and Pettet. Councilman Theoharous was absent. The Borough Attorney was present. The Borough Engineer was absent. The Mayor declared a quorum.

The Mayor read the following Sunshine Statement: Adequate notice of this meeting has been provided by the Mayor and Council by e-mailing notice of this meeting to the Suburban Trends and the Herald News newspapers on April 21, 2010 stating therein that this meeting would be held on Tuesday, April 27, 2010 at the time of 8:30 P.M., in the Wanaque Municipal Building, 579 Ringwood Avenue, Wanaque, New Jersey, and a copy of this notice was posted on the bulletin board in the Wanaque Municipal Building on April 21, 2010, and a copy is on file in the office of the Municipal Clerk.

INTRODUCTION OF THE 2010 CURRENT, WATER UTILITY AND SEWER UTILITY BUDGETS AND OTHER FINANCIAL AND BUDGETARY RESOLUTIONS (HOLD)

RESOLUTION #69-0-10:
Re: Change of Parade Route – Beginning area of Stephens Avenue southbound on
Ringwood Avenue to Third Avenue, Haskell

On entertainment of the Mayor, Councilwoman Cisco and Councilman Balunis moved that,

WHEREAS, the Wanaque Borough Fire Department requested that the County of Passaic allow the closure of Ringwood Avenue southbound from Conklintown Road to Second Avenue/Doty Road on June 12, 2010 between the hours of 1:30 P.M. to 3:30 P.M. in order for the Department to host its 100th Anniversary Parade; and
WHEREAS, the Governing Body of the Borough of Wanaque fully supports this activity;
NOW, THEREFORE, BE IT RESOLVED that the Governing Body of the Borough of Wanaque does hereby endorse the request of the Wanaque Borough Fire Department and requests the Passaic County Board of Chosen Freeholders to approve this application.

On roll call, all voted yes, and the Mayor declared the motion carried.
Councilwoman Cisco asked if there is enough room on Stephens Avenue, Furnace Avenue for all the vehicles.
The Borough Administrator said there should be. I was at a meeting tonight for the parade. The Mayor and I met with the County Engineer yesterday and we need to submit a plan.

RESOLUTION #70-0-10:
Re: Permission for a Block Party – Haskell Fire House (Fourth Avenue closed to traffic from Ringwood Avenue to Leonard Place)

On entertainment of the Mayor, Councilwoman Cisco and Councilman Balunis moved a motion to approve the aforementioned Resolution with the change from Leonard Place to the Boulevard,

BE IT RESOLVED that the Wanaque Borough Fire Department is granted a block party permit for June 12, 2010, to close down Fourth Avenue from Ringwood Avenue to Boulevard in conjunction with their 100th Anniversary festivities.

On roll call, all voted yes, and the Mayor declared the motion carried.

RESOLUTION #71-0-10:
Re: Approval of one day exception to Borough Ordinance 84-7.1A allowing alcoholic
beverage to be consumed on Borough property to be changed from Addice Park
to the Haskell Fire House

On entertainment of the Mayor, Councilmen Cortellessa and Balunis moved that,

WHEREAS, the Wanaque Borough Fire Department is celebrating its 100th Anniversary on June 12, 2010 with a parade along Ringwood Avenue and a festival at the Haskell Fire House; and
WHEREAS, the Wanaque Borough Fire Department has requested that the prohibition of alcoholic beverages on municipal property, Chapter 85-7.1 of the Borough Code be waived for the day; and
WHEREAS, the Wanaque Borough Fire Department has prepared a plan to limit alcohol consumption to one specific area of the property, and will provide adequate supervision so that alcohol is not brought into other areas of the park, and said plan is satisfactory to the Governing Body;
NOW, THEREFORE, BE IT RESOLVED that the Governing Body of the Borough of Wanaque does hereby relax the provisions of Chapter 84-7.1 regarding the consumption of alcoholic beverages on Borough property, solely during the hours of 1:00 P.M. to 8:00 P.M. on Saturday, June 12, 2010 for the Wanaque Borough Fire Department 100th Anniversary festival and only in the specific area designated for alcohol consumption; and
BE IT FURTHER RESOLVED that this exception is for this one specific event, and shall not be interpreted to allow alcohol consumption on any Borough property at any other time.
On roll call, all voted yes, and the Mayor declared the motion carried.

RESOLUTION #72-0-10:
Re: Request County permission to close a portion of Ringwood Avenue for Memorial Day Parade

On entertainment of the Mayor, Councilwoman Cisco and Councilman Pettet moved that,

BE IT RESOLVED that the Borough of Wanaque request that the County of Passaic permit the closing of Ringwood Avenue on Monday, May 31, 2010, for the Annual Memorial Day parade.

On roll call, all voted yes, and the Mayor declared the motion carried.

PUBLIC DISCUSSION:

The Mayor opened the Public Discussion.

Dave DaSilva, 108 Monroe Street, Haskell said why are you holding the budget again.
The Mayor said on Monday the State announced the Cap levy changed and we have to look at the budget again.
Dave DaSilva said this would allow you to increase taxes.
The Mayor said it increases the Cap and it would still be within the tax.
Dave DaSilva said this would allow an increase in taxes.
The Mayor said it would increase the taxes.

Kenneth Ambruster, 6 Gardella Place, Haskell said what was the Cap last year.
The Borough Administrator said four percent plus three hundred thirty thousand dollars.
Kenneth Ambruster said is it the same this year.
The Borough Administrator said no it needs to be recalculated into the rate. Not an additional three hundred thirty thousand dollars and the auditor will recalculate it.
Kenneth Ambruster said when will copies of the budget be available and when will it be introduced.
The Mayor said at the May 10th meeting.

The Mayor closed the Public Discussion.

NEW BUSINESS:

Closed Session:
Re: Negotiations/Personnel/Litigation

On entertainment of the Mayor, Councilman Pettet and Councilwoman Cisco moved that,

WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975, (N.J.S.A. 10:4-1) permits the exclusion of the public from a meeting in certain circumstances; and
WHEREAS, This public Body is of the opinion that such circumstances presently exist;
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Wanaque, County of Passaic, State of New Jersey, as follows:
1. The public shall be excluded from discussion of action upon the hereinafter specified subject matter.
2. The general nature of the subject matter to be discussed is as follows:
1) Labor Negotiations.
3. The Mayor and Council shall release and disclose to the general public the
discussion and actions taken on the subject matter of the above mentioned closed session when the reasons for discussing and acting on the matter in closed session no longer exist, but no later than one month of the Mayor and Council arriving at a final decision on the specified subject matter.

On roll call, all voted yes, and the Mayor declared the motion carried.

RECONVENEMENT:

On entertainment of the Mayor, Councilmen Cortellessa and Balunis moved a motion to reconvene at 9:00 P.M.
On roll call, all were present.

ADJOURNMENT:

On entertainment of the Mayor, Councilmen Pasquariello and Pettet moved a motion to adjourn the meeting.
On roll call, all voted yes, and the Mayor declared the motion carried; meeting adjourned at 9:00 P.M.
