Meeting called to order by Chairman Foulon with a salute to the flag.

ROLL CALL:

Chairman Gilbert Foulon, David Slater, Mayor Dan Mahler, Eugene Verba, Kevin Platt, Ed O’Connell

PRESENT: Attorney Steven Veltri and Engineer Michael Cristaldi

ABSENT: Members John Di Meglio, Joseph Graceffo, William Rucci and John Shutte.

This is a Regular Meeting of the Wanaque Borough Planning Board and adequate notice has been given and it has been duly advertised by the placement of a notice in the Trends and the Herald News, mailed on January 18, 2008 and a notice thereof has been posted on the bulletin board in the Municipal Building in the Borough of Wanaque and a copy thereof has been on file with the Borough Clerk.

MINUTES: from the March 20, 2008 Meeting.

MOTION TO APPROVE: made by Member Platt, seconded by Member Slater, voting yes were Chairman Foulon, Members Platt and Slater. Abstaining were Mayor Mahler, Members Verba and O’Connell.

COMMUNICATIONS / REPORTS: No questions asked.

APPLICATION STATUS: Engineer Cristaldi said there were no new applications.

NEW BUSINESS APPLICATON “COMPLETE SYSTEM INTEGRATION, INC.” (Computer Consulting), 1069 Ringwood Ave., Suite 311 B, Block 430 Lots 1.03, 9-13, “Bald Eagle Urban Renewal at Wanaque” Town Centre. The developer and owner of the project is Sal Falciglia, 170 Cahill Cross Rd., #311, West Milford, N.J. The owner of the business is Tim Morgner, 120 Fountain Drive, Suite 101, Ringwood, N.J. 07456.
Mr. Morgner came forward and said he is the President and owner of the business. Mr. Morgner said his business is an IT Consulting Company and provide IT out sourcing services and project management type services for corporations in the Metro Area. Two employees will be there and sub-contractors who don’t come to the office and go directly to the customer sites do a lot of it.
Chairman Foulon said all of the inspections are in compliance.

MOTION TO APPROVE: made by Member Slater, seconded by Mayor Mahler, voting yes were Chairman Foulon, Mayor Mahler, Members Platt, Slater, Verba and O’Connell.

NEW BUSINESS APPLICATION “Old Skool Addicts” (Automotive Repair), 1185 Ringwood Ave., Block 448 Lot 8.01, Haskell, N.J. The owner of the building is Cosimo Santoro, 27 Dartmouth Rd., Wayne, N.J. The owner of the business is Arthur Typaczewski, 19 Bailey Ave., Bloomingdale, N.J.
Arthur Typaczewski owner of the business came forward. Chairman Foulon wanted to know if the owner of the building is here tonight and the owner was not present. Mr. Typaczewski said it’s a new business trying to start and he currently co-owns Black Oak Auto Body in Wayne. Mr. Typaczewski said what they found was that there is cliental for specialized vehicle restoration and fabrication to a select type of people. This is not an auto body shop and this is a separate type of business. There will be minor auto body repair and no spraying there and that will be done at the shop in Wayne. They will be disassembling and a lot of stuff that will be sand blasted or powdered coated will be subcontracted out and final assembly, electrical work, and final mechanicals will be done at the shop on Ringwood Avenue.
Chairman Foulon told Mr. Typaczewski that the building on Ringwood Avenue is a mess and doesn’t want to approve anything to go into that building until the landlord fixes it up.
Chairman Foulon suggested that Mr. Typaczewski get together with the landlord and tell him to fix the building up and then the Board will be more than happy to talk to him. Chairman Foulon added that the whole building needs to be renovated and a good cleaning up and suggested the landlord come before the Board.

NEW BUSINESS APPLICATION “All Climate Inc.” (A/C/Heat/Refrigeration), 566 Ringwood Ave., Block #448 Lot 8.01, Wanaque, N.J. The owner of the building is Peter Orsini, 35 Borman Drive, Wanaque, N.J. The owner of the business is Philip Pace, 151 Clinton Rd., Newfoundland, N.J. 07435.
Mr. Pace owner of the business came forward. Mr. Pace said there are employees out on the road and get dispatched and just come in to drop off their paperwork. In the office are just Mr. Pace and his secretary and she only works 3 days a week. There is parking in the back and there would be no parking problem. Chairman Foulon said all inspections are in compliance.

MOTION TO APPROVE: made by Member Slater, seconded by Member O’Connell, voting yes were Chairman Foulon, Mayor Mahler, Members Platt, Slater, Verba and O’Connell.

NEW BUSINESS APPLICATION: “Brittany’s Place” (Luncheonette/Deli) formerly Midvale Sweet Shop, 548 Ringwood Ave., Block 229 Lot 6. Owner of building is Ahmad Faqirgan, 708 Berdan Ave., Wayne, N.J. Owner of business is Damian Wesler, 1551 Greenwood Lake Tpke., Hewitt, N.J.

Alan Burke and Brittany De Falco came forward. Mr. Burke will be doing the cooking on the premises for the owner. They will be running the same type of business that was there previously. Chairman Foulon told the applicants that according to the Fire Prevention Bureau their Fire Extinguisher needs service and they need an Exit Sign over rear exit. Chairman Foulon also mentioned that they need plumbing work. Mr. Burke said there is two small bathrooms and will be turned into unisex and handicap accessible. They are planning on doing some floor tiling, Pergo flooring, drop ceiling and painting.

MOTION TO APPROVE SUBJECT TO SATISFACTORY INSPECTIONS: made by Member Platt, seconded by Member O’Connell, voting yes were Chairman Foulon, Mayor Mahler, Members Platt, Slater, Verba and O’Connell.

RESOLUTION on New Business Application for Solmar Spa Wanaque, Inc. d/b/a/ “Nail & Skin Care”, 1069 Ringwood Ave., Block 430 Lots 1.03 and 9-12, Haskell, N.J.

MOTION TO APPROVE: made by Member Slater, seconded by Member Platt, voting yes were Chairman Foulon, Members Platt, Slater, Verba and O’Connell. Mayor Mahler abstained.

NEW BUSINESS APPLICATION: “Skylands Preschool” (Day Care Center), 1141 Ringwood Ave., Block 436 Lot 7. Owner of property is Scott Walker, 1135-1141 Ringwood Ave., Haskell, N.J. Owner of business is Jennifer Lippe, 118 Buena Vista Dr., Ringwood, N.J. Ms. Lippe is here tonight with a Site Plan as requested by the Board last month.
Ms. Lippe came forward with the landlord of the building, Scott Walker. Chairman Foulon said to Ms. Lippe that at the last meeting, the Board set some criteria of which she hasn’t met. Ms. Lippe said she was hoping to get into the building to start renovating. Ms. Lippe said she already showed the Board the preliminary from the architect and tonight she has a survey. Chairman Foulon said the Board was supposed to see a site plan tonight. Mr. Walker, the owner of the building, said the survey shows all the parking, the ingress and egress and is pretty detailed. Chairman Foulon said this would have to be submitted to the Board Engineer for his review. Mr. Walker said he was confused because he thought the applicant was here tonight for a Certificate of Occupancy. Atty. Veltri told Mr. Walker, what the Board tried to explain last month, was the fact that these applications are not similar to other business applications because they involve state regulations, health and safety criteria and as a Planning Board they are looking to have that criteria met. Atty. Veltri added, that the Board does not look at these applications based upon what the inspectors tell them, but what they want is to see a site plan submitted and copies for everyone to look at, they want the engineer to review it, the Board wants to ask questions about the site plan, the operation and would also like to see what the state criteria was. Mr. Walker said Ms. Lippe has that information from the state and it has been approved. Atty. Veltri responded and said, Ms. Lippe having it and the Board having it are two different things. Atty. Veltri said what you do is apply for a Site Plan Application for this use and all the criteria are in the application. The number of site plans that need to be submitted, the state criteria should be submitted, the Board Engineer should have a chance to look at it reflect upon it and give the Board advice and questions will be asked at a Public Hearing. Mr. Walker said his surveyor is Boyce L. McGeoch and he said that they have plenty of egress for the children to walk from the building to the playground area; the state didn’t have a problem with any of this. Mr. Walker was wondering if there was another way rather than coming back before the Board because he will be losing another month’s rent on the space.
Chairman Foulon told Mr. Walker that a site plan will have to be submitted and the engineer will have to review it and the engineer will advise the Board and he probably will have questions for the applicant regarding the site plan. Ms. Lippe asked where does she get a site plan application? Atty. Veltri said his opinion was at the last meeting was why were they here on a New Business Application; these are Site Plan Applications not New Business Applications, they involve children, safety criteria and the Board needs to know what’s going on site. If the Board doesn’t have this and they approve something like this, and don’t have proper parking or drop off areas or safety areas for the children to play in, the Board can be sued and Atty. Veltri will not let that happen to the Board or the Municipality. Engineer Cristaldi spoke and said they may also need County approval because this property is on a County road. Ms. Lippe said according to the State Inspector, she was told she didn’t need County approval because they weren’t building a new center.
Atty. Veltri reiterated, that once the Board receives a site plan, they can give the applicant meaningful feedback.

MOTION TO APPROVE RESOLUTION ADOPTED AT THE JANUARY 17, 2008 MEETING TO BE MEMORIALIZED IN WRITING AND CONFIRMED FOR THE REDEVELOPMENT AREA ALONG RINGWOOD AVENUE SOUTH OF DOTY ROAD BE APPROVED AND SUBMIT THE RESOLUTION TO THE MAYOR & COUNCIL: made by Member Verba, seconded by Member Slater, voting yes were Chairman Foulon, Mayor Mahler, Members Platt, Slater, Verba and O’Connell.

VOUCHERS: submitted by Atty. Veltri for Solmar Spa Wanaque, Inc. (“Nail & Skin Salon”) Block 430 Lots 1.03 and 9-12 Ringwood Ave. for preparation of Resolution for $175.00.

MOTION TO APPROVE: made by Member O’Connell, seconded by Member Slater, voting yes were Chairman Foulon, Mayor Mahler, Members Platt, Slater, Verba and O’Connell.

PUBLIC DISCUSSION:
Grace Maiello, 26 Rhinesmith came forward. Ms. Maiello wanted to know if the Resolution that was voted on a few minutes ago was for the Haskell Section. Chairman Foulon said yes and it is South of Doty Road.
