July 12, 2010

A Business Meeting of the Mayor and Council of the Borough of Wanaque was held on Monday, July 12, 2010, at 7:00 P.M. in the Wanaque Municipal Building.

The Mayor called the meeting to order.

On roll call, the following Council Members responded: Balunis, Cisco, Cortellessa, Theoharous. Councilmen Pasquariello and Pettet were absent. The Mayor declared a quorum. The Borough Attorney and Borough Engineer were present.

The Mayor read the following Sunshine Statement: This is a Business meeting of the Mayor and Council and adequate notice thereof has been given by advertising the date, time and place of the Business meeting in the Suburban Trends and the Herald News newspapers and was e-mailed to these papers on January 6, 2010, and a notice thereof has been posted on January 6, 2010 on the bulletin board in the Wanaque Municipal Building, 579 Ringwood Avenue, Wanaque, New Jersey and a copy thereof has been on file in the office of the Municipal Clerk.

Regular Meeting of June 14, 2010.

On entertainment of the Mayor, Councilman Cortellessa and Councilwoman Cisco moved a motion to approve the aforementioned Minutes.
On roll call, all voted yes, except Councilman Theoharous who abstained and the Mayor declared the motion carried.

ORDINANCES:

Public Hearing of Ord. #9-0-10:
Re: Bond Ordinance – Ringwood Avenue - Phase III

On entertainment of the Mayor, Councilmen Cortellessa and Balunis moved a motion that Ordinance #9-0-10 be taken from the table and read by the Clerk, by title only, for consideration of final reading.
On roll call, all voted yes, and the Mayor declared the motion carried.

The Clerk took from the table and read by title only as follows: BOND ORDINANCE PROVIDING FOR THE IMPROVEMENT OF RINGWOOD AVENUE IN AND BY THE BOROUGH OF WANAQUE, IN THE COUNTY OF PASSAIC, NEW JERSEY, APPROPRIATING $850,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $809,500 BONDS OR NOTES OF THE BOROUGH FOR FINANCING SUCH APPROPRIATION.

This Ordinance has been duly advertised in accordance with the statutes; a copy was posted on the bulletin board in the Municipal Building, a copy was available for the public to read in the Clerk's office; and copies are available for the public present here this evening.

The Mayor opened the Public Hearing.

The Borough Administrator explained the project and the time frame of possibly two years and then there will be a sidewalk assessment.
Dave DaSilva, 108 Monroe Street, Haskell said is it possible to communicate with the businesses on the website as to the progress of the project.
The Borough Administrator said we can put it on the website.
Dave DaSilva said can you project estimate when the work goes on in an area.
The Borough Administrator said we will work with the County for a schedule.
Dave DaSilva said as a business owner there is a concern for getting in and out of the businesses.
The Borough Administrator said they will be working from 9:00 A.M. to 3:00 P.M.

Councilman Pettet arrived at 7:10 P.M.

Kenneth Ambruster, 6 Gardella Place, Haskell what is the condition of the storm drains on Ringwood Avenue.
The Borough Administrator said it floods when there are substantial rains.
The Mayor said the flooding usually goes away as soon as the rain stops.

Don DeGroat, 480 Ringwood Avenue, Wanaque said is the sidewalk assessment the next Ordinance to be discussed.
The Mayor said yes.

The Mayor closed the Public Hearing.

Councilman Cortellessa and Councilwoman Cisco moved that,

BE IT RESOLVED that an Ordinance entitled: BOND ORDINANCE PROVIDING FOR THE IMPROVEMENT OF RINGWOOD AVENUE IN AND BY THE BOROUGH OF WANAQUE, IN THE COUNTY OF PASSAIC, NEW JERSEY, APPROPRIATING $850,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $809,500 BONDS OR NOTES OF THE BOROUGH FOR FINANCING SUCH APPROPRIATION pass final reading and that said Ordinance be adopted as an Ordinance of the Borough of Wanaque; and
BE IT FURTHER RESOLVED that the Borough Clerk be and she is hereby directed to cause said Ordinance to be published in the manner prescribed by law.

Public Hearing of Ord. #10-0-10:

The Mayor opened the Public Hearing.

Don DeGroat, 480 Ringwood Avenue, Wanaque said there are tax exempt properties and another church not paying the sidewalk assessment.
The Borough Administrator said they are not exempt and the assessment has not been applied yet.
Don DeGroat said the curbs are six to eight inches higher than the rest of the road and it is a concern. Also the quality of the concrete being used is a concern.

Dave DaSilva, 108 Monroe Street, Haskell said how much cost will not be recouped to the Borough and how is the payment applied to the bond.
The Borough Administrator said there is a dedicated account for it.

Jerry Bluse, 565 Ringwood Avenue, Wanaque said is the Rhinesmith property on Ringwood Avenue still owned by the school and is any property exempt from the assessment.
The Borough Administrator said no the school does not own that property. The Borough hall, Fire Department and Library are exempt.

Sandy Lawson, 28 Haskell Avenue, Haskell said there should be a sidewalk fund established for this and it was mentioned several years before.

Frank Potanka, 401 Ringwood Avenue, Wanaque said now the water comes onto the property because the sidewalks are so low and the storm drain is falling apart.
The Borough Administrator said the Engineer will address that issue.
Frank Potanka said the egress to the property we park cars on the property because there isn’t enough room and the road is deteroriating.
The Borough Administrator said the County will not allow that any longer and the Engineer has maps here that can be looked at.

Don DeGroat, 480 Ringwood Avenue, Wanaque said are the plans available now and can I get a copy.
The Borough Administrator said I just got them tonight and you can have a copy.

Councilmen Pettet and Cortellessa moved that,

The Clerk took from the table and read by title only as follows: BOND ORDINANCE PROVIDING FOR THE IMPROVEMENT OF THE DRAINAGE SYSTEM IN AND ALONG SECOND AVENUE IN AND BY THE BOROUGH OF WANAQUE, IN THE COUNTY OF PASSAIC, NEW JERSEY, APPROPRIATING $185,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $176,100 BONDS OR NOTES OF THE BOROUGH FOR FINANCING SUCH APPROPRIATION.

The Mayor opened the Public Hearing.

Cheryl Davis, 14 Second Avenue, Haskell said is there a chance this will be done this year.
The Mayor said we’re not sure it will be this year. The Engineer will draw up the plans.
Cheryl Davis said what is the process.
The Mayor explained the process for the bids.
The Borough Administrator said it will be about three to four months for the design to go to the Community Development Block Grant for approval and the bid would probably be sometime in November or December and when the weather breaks they can be underway with the construction which is possibly in March.

Dave DaSilva, 108 Monroe Street, Haskell said thank you for Second Avenue. Does Arrow Group have the plans and does it involve the neighborhood. Should keep up with the process.
The Borough Administrator said other than when they are in the road not a lot is being done.
Dave DaSilva said should have the plans here and keep people informed. How much is Federal money.
The Borough Administrator said eighty five thousand dollars is Federal money and the balance is the Borough.

Councilmen Pettet and Cortellessa moved that,

BE IT RESOLVED that an Ordinance entitled: BOND ORDINANCE PROVIDING FOR THE IMPROVEMENT OF THE DRAINAGE SYSTEM IN AND ALONG SECOND AVENUE IN AND BY THE BOROUGH OF WANAQUE, IN THE COUNTY OF PASSAIC, NEW JERSEY, APPROPRIATING $185,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $176,100 BONDS OR NOTES OF THE BOROUGH FOR FINANCING SUCH APPROPRIATION pass final reading and that said Ordinance be adopted as an Ordinance of the Borough of Wanaque; and
BE IT FURTHER RESOLVED that the Borough Clerk be and she is hereby directed to cause said Ordinance to be published in the manner prescribed by law.

The Borough Administrator said yes based on the net base salary and they are contributing to health cap.
Dave DaSilva said can I have a copy of the Resolution.

BE IT FURTHER RESOLVED that the Borough Clerk be and she is hereby directed to cause said Ordinance to be published in the manner prescribed by law.

On entertainment of the Mayor, Councilmen Balunis and Cortellessa moved that,

AN ORDINANCE TO AMEND THE CODE OF THE BOROUGH OF WANAQUE, CHAPTER 108, VEHICLES AND TRAFFIC TO ESTABLISH “NO PARKING” ON THE SOUTH SIDE OF FIRST STREET pass first reading, and that said Ordinance be further considered for final passage and adoption at a meeting of the Borough Council to be held on the 9th day of August 2010, at the Municipal Building in the Borough of Wanaque at 7:00 P.M., and that at such time and place all persons interested be given an opportunity to be heard concerning said Ordinance; and
BE IT FURTHER RESOLVED that the Borough Clerk be instructed to publish in the manner provided by law a copy of said Ordinance, together with introduction thereof and notice when same will be considered for final passage and adoption.

COMMITTEE REPORTS:

Councilman Balunis:

Councilman Balunis reported on recreation the summer recreation camp began and the blue collar union rejected the contract.

Councilwoman Cisco:

Councilwoman Cisco reported on the Local Assistance Board is no longer and thanks to the Welfare Director. The Board of Adjustment had no meeting, the First Aid Squad had no meeting and there is a Freeholder meeting tomorrow night.

Councilman Cortellessa:

Councilman Cortellessa reported the equipment is being replaced that needs to be. The water department has no restrictions and they are getting quotes for a backhoe. The trucks transmission went and there was a water main break on Crescent Road over the weekend.

Councilman Pasquariello:

Absent.

Councilman Pettet:

Councilman Pettet reported the Open Space meeting is August 30th. At Lakeland Al Guazzo retired and will be missed.

Councilman Theoharous:

Councilman Theoharous reported the Fire Department had put in seven hundred forty seven hours of time for six months and three thousand one hundred twenty eight hours total.

The Borough Administrator said the refund of application fees are not refundable in the future.

PUBLIC DISCUSSION:

The Mayor opened the Public Discussion.

Kenneth Ambruster, 6 Gardella Place, Haskell said is there any water conservation now.
Councilman Cortellessa said I spoke to the Water Supervisor today and we are in good shape.
Kenneth Ambruster said are recyclables being accepted for all numbers one through seven. I heard that they were.
The Borough Administrator said I will check with the contractor.
Kenneth Ambruster said if is true please get the information out.

Sandy Lawson, 28 Haskell Avenue, Haskell said what is the status of the Municipal parking lot.
The Mayor said we are looking to have it demolished.
Sandy Lawson said the sign for the Municipal parking lot is small and the sidewalks are in horrible condition. There is also a pond in the middle of the parking lot. Anything you can do to make it better would be appreciated.

Don DeGroat, 480 Ringwood Avenue, Wanaque said regarding Ordinance 13-0-10 the street is very narrow and would recommend you to exclude the church on Sunday mornings.
The Mayor said people approached me and made some comments about the school.
Don DeGroat said also the parking for the picnic was overwhelming for the fire trucks.

Kenneth Ambruster, 6 Gardella Place, Haskell said regarding the electricity is it just for the town or any resident.
The Borough Administrator said only the town. The other plan just went by the wayside.

Dave DaSilva, 108 Monroe Street, Haskell said I don’t agree with the combined meetings. On Doty Road at the traffic light the arrows are not marked clearly on the ground for the lanes. Is there an update on the condition of Mountain Lakes Estates.
The Borough Attorney said there is a report from the Building Inspector and photographs. Could consider a lawsuit but it is still in the appellate Court and they are waiting for a decision on the other suit to go forward with the suit on the deficiencies.
Dave DaSilva said is there anything the town can do for the safety concerns.
The Borough Attorney said there are safety issues there.
Dave DaSilva said I implore you to go up on the property and take a look. What is the status with the sewer utility and sewer dissolution of the Regional Sewer Authority.
The Borough Administrator said there is nothing new yet.

Don DeGroat, 480 Ringwood Avenue, Wanaque said there is a concern with pedestrian safety on Ringwood Avenue with the volume of truck traffic and the speed is too much. Ringwood Avenue is not walker friendly. Suggest to reduce the speed and I understand it is the County. The location of the speed signs is not safe for children where they are marked and the signs for stop for pedestrian safety I purchased two from myself.
The Borough Administrator said I understand the concerns and in order to change the speed limits it has to be done by the town, County and State Department of Transportation.

Sandy Lawson, 28 Haskell Avenue, Haskell said there is a need for a traffic study and is there a limit on traffic studies.
The Borough Administrator said those studies are based on vehicular traffic volume and don’t address the speed. The speed limits are the Municipal jurisdiction. I will speak to the County Engineer tomorrow.

The Borough Engineer said there were some questions on the sidewalks some are somewhat new and they did not replace the newer sidewalks and curbs in some areas. Is there a reduced cost to residents for the sidewalks.
The Borough Administrator said some areas across Orechio Drive the sidewalks are newer. Some sidewalks will stay where the elevations are correct.
The Borough Engineer said the sidewalks not on your property you are responsible for.

Betsy Arnoldi, 450 Ringwood Avenue said the four feet sidewalk proposed is wider than now.
Councilwoman Cisco said and the telephone poles are in the right of way.
The Borough Administrator said they are not being moved.
Don DeGroat, 480 Ringwood Avenue, Wanaque said the sidewalks are about three and a half feet wide.

CONSENT AGENDA:

Resolution #117-0-10:
Re: Redemption of Tax Sale Certificate #08-00189 for Block 271, Lot 12 in the
amount of $23,000.00

WHEREAS, a Tax Sale was held for 2008 delinquent Municipal charges on September 30, 2009, and
WHEREAS, US Bank-Cust/Sass Muni V dtr was the successful bidder for Block 271 Lot 12 for which Tax Sale Certificate #08-00189 was assigned, and
WHEREAS, the property owner has redeemed said certificate of which funds have been deposited into the Current Account.
NOW, THEREFORE, BE IT RESOLVED that the Treasurer shall refund to the lien holder the amount of $23,000.00 for the premium as per the certification of the Tax Collector.

BE IT RESOLVED that Richard A. Alaimo Associates is authorized to proceed with the design and construction of the Second Avenue Drainage Improvement in an amount not to exceed $27,000 as per their proposal dated May 18, 2010; and
BE IT FURTHER RESOLVED that the Chief Financial Officer has certified that funds are available in budget account X-GC-03-365-000.

Resolution #119-0-10:
Re: Co-Op Pricing Agreement – County of Passaic for Electricity

On entertainment of the Mayor, Councilmen Theoharous and Pettet moved that,

WHEREAS, N.J.S.A. 40A:11-11 (5) authorizes two or more contracting units to establish a Cooperative Pricing System and to enter into a Cooperative Pricing Agreement for its administration; and
WHEREAS, the County of Passaic, State of New Jersey has established a Cooperative Pricing System for the purchase of energy and will serve as the lead Agency; and
WHEREAS, the Borough of Wanaque wishes to participate in the Passaic County Cooperative Pricing System for energy.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Borough Clerk of the Borough of Wanaque are authorized and directed to enter into a Cooperative Pricing Agreement with the County of Passaic, who will serve as the Lead Agency.

BE IT RESOLVED that the 2010 Salary Resolution be amended to add the following, retroactive to January 1, 2010.
